Managers or other authorised persons acting on behalf of your organisation providing personal information about someone else, are responsible for ensuring that they comply with any obligation and consent obligations under applicable data protection laws in relation to such disclosure. In so far as required by applicable data protection laws, they must ensure that they have provided the required notices and have obtained the individual’s explicit consent to provide us with the information and that they explain to the individual how we collect, use, disclose and retain their personal information or direct them to read this Privacy Notice.
In limited circumstances, you may be approached for your written consent to allow us to process certain particularly sensitive data. You should be aware that you are not required to agree to any request for consent. However, failure to consent may lead to us being only able to provide a reduced service or you may be prevented from accessing the portal, applications, website or services.

We may only use information relating to criminal convictions where the law allows us to do so. This will usually be where such processing is necessary to carry out our obligations and provided we do so in line with our data protection policy.

We do not envisage that any information will be transferred outside of the EU, however we will notify you in writing if this position changes and provide you with further details including the name of any such country and what protection we have put in place to ensure that your personal information is treated by those third parties in a way that is consistent with and which respects the EU and UK laws on data protection.

You may be able to configure your browser to restrict cookies or block all cookies if you wish, however if you disable cookies you may find that this affects your ability to use certain parts of our portal, website, applications or services.
We may keep a record of traffic data which is logged automatically by our servers, such as your IP address, device information, the website that you visited before ours and the website you visit after leaving our site. We also collect some site, application and service statistics such as access rates and page views. We are not able to identify any individual from such data or statistics.

How long will you use my information for?
We will only retain your personal information for as long as necessary to fulfil the purposes we collected it for, and for the purposes of satisfying any legal, accounting, or reporting requirements. To determine the appropriate retention period for personal data, we consider the amount, nature, and sensitivity of the personal data, the potential risk of harm from unauthorised use or disclosure of your personal data, the purposes for which we process your personal data and whether we can achieve those purposes through other means, and the applicable legal requirements.
Where we act as a data controller and where necessary and to the extent permitted by law, we may retain information about you after the closure of your organisation’s account or if your organisation’s application for an account is declined or it decides not to proceed.
Where we act as a data processor in some circumstances we may anonymise your personal information so that it can no longer be associated with you, in which case we may use such information without further notice to you. Once you are no longer an employee, worker or contractor of the organisation you work for we will retain and securely destroy your personal information in accordance with applicable laws and regulations. 9

If you are acting as a client and want to review, verify, correct or request erasure of your information, object to the processing of your personal data, or request that we transfer a copy of your personal information to another party, please contact us by email at GDPR@eledecks.com. [For example a Finance manager may act on behalf of his/her employer to request correction to company data shared during the course of the contractual relationship between Eledecks and their organisation, such as company banking details.]
If you are acting as a Data Controller and want to review, verify, correct or request erasure of personal information, object to the processing of personal data, or request a transfer of a copy of personal information to another party, please use the Portal tools for this purpose where appropriate, alternatively if that is not possible please contact us by email at GDPR@eledecks.com. [For example an HR manager whose organisation subscribes to the Portal may use the export feature to provide an employee with a portable copy of personal data from Personnel Records.]
If you are acting as an employee of a client organisation (The Data Controller) and you have been issued with a self-service Personnel Dashboard you will be able to make any or all of the above requests to the Data Controller online through your dashboard. Alternatively, you can make the request offline to your employer. In the rare circumstances where Eledecks is acting as the Data Controller you can write to us at GDPR@eledecks.com.

You will not have to pay a fee to access your personal information (or to exercise any of the other rights). However, we may charge a reasonable fee if your request for access is clearly unfounded or excessive. Alternatively, we may refuse to comply with the request in such circumstances.
What we may need from you
We may need to request specific information from you to help us confirm your identity and ensure your right to access the information (or to exercise any of your other rights). This is another appropriate security measure to ensure that personal information is not disclosed to any person who has no right to receive it.
RIGHT TO WITHDRAW CONSENT
In the limited circumstances where you may have been asked for your consent, and have provided such consent for the collection, processing and transfer of your personal information for a specific purpose, you have the right to withdraw your consent for that specific processing at any time.
To withdraw your consent, please use the online tools provided or email us at GDPR@eledecks.com. Once we have received notification that you have withdrawn your consent, we will take immediate steps to deal with your request. We will keep you informed throughout the process.
